A few of the most common disclosure topics that may apply in Nevada real estate transactions.
Agency relationships
Real estate licensees may represent the seller, the buyer, or both parties in a limited capacity depending on the arrangement. Ask for an explanation of who is represented, what duties are owed, and how confidentiality is handled.
Property condition disclosures
Sellers are typically required to disclose known material facts about the property’s condition. Buyers should review disclosures carefully and obtain inspections to verify condition and identify concerns.
Lead-based paint (pre-1978 homes)
Federal law requires specific disclosures and an informational pamphlet for homes built before 1978. Buyers generally have an opportunity to conduct a lead-based paint risk assessment or inspection.
Homeowners association (HOA) and resale package
If the property is in an HOA, buyers may receive governing documents, budgets, and other HOA information. Review rules, fees, and any pending assessments before removing contingencies.
Financing and appraisal
Loan approval and appraisal are separate steps. Terms can change based on underwriting, property condition, and valuation. Confirm timelines and required documentation with your lender.
Fair housing
